By accessing, browsing, or purchasing through the Rooted platform (“Rooted,” “Company,” “we,” “our,” or “us”), you, as the end user, customer, or purchaser (“you” or “your”), expressly acknowledge, agree, and represent that Rooted functions solely as an online marketplace facilitator, connecting independent small businesses, vendors, sellers, contractors, and service providers (collectively, “Vendors”) with potential customers, and that Rooted does not itself design, manufacture, produce, warehouse, ship, fulfill, package, advertise, guarantee, endorse, test, inspect, or otherwise exercise control over any product, service, or offering made available for sale by any Vendor through the Rooted platform. Rooted is not a merchant of record and does not, under any circumstance, assume or accept responsibility for the quality, safety, legality, authenticity, condition, accuracy, timeliness, performance, merchantability, or fitness for a particular purpose of any goods or services purchased through the Rooted marketplace.
All policies governing refunds, returns, cancellations, exchanges, warranties, guarantees, remedies, or adjustments of any kind are determined exclusively and unilaterally by the individual Vendor from whom the product or service is purchased. Each Vendor retains sole, absolute, and final discretion to grant or deny any request for refund, return, exchange, or credit, in whole or in part, on any grounds whatsoever, and Rooted has neither the authority nor the obligation to direct, alter, override, intervene in, or compel any Vendor’s decision in relation to such matters. Rooted does not set, manage, or enforce any refund or return policy on behalf of any Vendor, nor does Rooted provide any independent refund, return, or exchange rights of its own.
By completing a purchase through Rooted, you expressly agree and understand that: (i) all claims, disputes, inquiries, or complaints regarding refunds, returns, or exchanges must be presented directly to the Vendor from whom the product or service was purchased; (ii) Rooted has no obligation to investigate, mediate, arbitrate, resolve, or otherwise involve itself in any dispute between you and any Vendor regarding such claims; (iii) Rooted shall not be liable to you or to any third party for any actual or alleged loss, damage, cost, expense, inconvenience, dissatisfaction, injury, delay, misrepresentation, defect, deficiency, or harm of any nature arising out of or relating to refunds or returns; (iv) any remedy available to you shall lie solely and exclusively against the Vendor in question and not against Rooted; and (v) you waive and release any right to assert a claim, demand, or cause of action against Rooted, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns for any issue relating to refunds or returns.
Rooted makes no warranties, express or implied, regarding the existence, sufficiency, adequacy, reasonableness, or enforceability of any Vendor’s refund or return policy, and expressly disclaims any responsibility for Vendor representations, whether made in writing, orally, online, in advertising, or otherwise. Vendors are entirely independent entities, not employees, partners, or agents of Rooted, and Rooted does not endorse or guarantee their practices. You assume all risk in transacting with any Vendor, and you acknowledge that Rooted’s role is limited to providing the technological platform by which you may engage with Vendors.
You further agree to hold Rooted harmless and indemnify Rooted against any and all claims, demands, actions, suits, proceedings, damages, liabilities, losses, costs, or expenses (including without limitation reasonable attorneys’ fees and court costs) that may arise from or relate to (a) any dispute, complaint, or claim concerning refunds, returns, or exchanges of Vendor products or services, and/or (b) any act or omission of a Vendor with whom you have conducted business.
For the avoidance of doubt, Rooted shall not issue refunds, accept returns, process exchanges, or provide financial or other restitution on behalf of any Vendor, and no statement on the Rooted platform, whether written, visual, or implied, shall be construed as creating any such obligation. Any representations made by Vendors regarding their refund or return practices are theirs alone and are not attributable to Rooted. Rooted shall not be liable for any reliance placed upon Vendor statements, nor for any Vendor’s failure to honor its own stated policies.
By transacting through Rooted, you acknowledge that you have read, understood, and agreed to this Refunds and Returns Policy in its entirety and that you assume all risks associated with purchasing from independent Vendors. This Policy shall survive termination of your use of the Rooted platform and shall remain binding with respect to any transactions initiated during your use of the platform.
